Daraja HTTP Framework (c) 2016 Michael Justin

This copyright applies to all source code, compiled code,
documentation, graphics and auxiliary files, except those
parts written by other people (which are normally copyright
their authors).

In this license, "the Licensor" means Michael Justin,
Habarisoft, and "you" means the business that purchased the
subscription.

Daraja is dual-licensed. It is available at no charge under
the GNU Affero General Public License v3 (AGPL). This
commercial license releases you from the AGPL's obligations,
in particular the requirement to publish the complete source
code of any application built with Daraja.


GRANT OF LICENSE
Subject to the conditions below, the Licensor grants you a
non-exclusive, worldwide, non-transferable license, under
which you may, for each licensed developer seat:

a) use the Daraja HTTP Framework ("the Framework") to write
   and compile your own application programs;

b) modify the Framework's source code for use in your own
   programs, without any obligation to publish those
   modifications;

c) run your programs, and make them available to others over
   a network (including as a hosted or software-as-a-service
   offering), on any number of servers, for any number of
   users;

d) reproduce and distribute your programs in executable
   (compiled) form only, royalty-free and without additional
   license fees; and

e) allow the recipients of your programs to install and run
   them on their own servers.


TERM AND COVERED VERSIONS
Your license covers the version of the Framework that is
current when your subscription starts, and every version
released while your subscription is active. The license for
those versions is perpetual: it does not end when the
subscription ends. After the subscription ends you may
continue to develop with, use and modify those versions, and
to run and distribute programs built with them, under these
terms.

Versions released after your subscription has ended are not
covered by this license. They are available under the AGPL
only, unless you renew the subscription.

The Licensor may terminate this license if you materially
breach its terms and do not remedy the breach within thirty
(30) days of being notified of it.


CONDITIONS

1. Your distribution of the programs must comply with all
   conditions listed in this agreement and any related
   agreements, including the Licensor's Terms of Service
   (https://www.habarisoft.com/terms.html).

2. You are solely responsible for your programs and for any
   warranties, support or other commitments you give to your
   own customers. Such commitments do not bind the Licensor.

3. The distribution of your programs must not violate any
   applicable laws or regulations.

4. Every developer who writes, modifies or maintains code that
   uses the Framework must hold a licensed developer seat
   covering the Framework version in use. Build servers,
   continuous integration systems, testers and end users of
   your programs do not need a seat.

5. Your programs must add primary and substantial functionality,
   and may not be merely a set or subset of the Framework.

6. This license lets you, the developer, use the Framework to
   build and distribute your own programs; it does not pass
   that right on to the people who use those programs. Your
   license does not permit the people who receive your programs
   to use the copy of the Framework embedded in them to develop
   separate software of their own, or to extract, redistribute
   or otherwise pass on the Framework itself. This applies
   regardless of any modifications you make or how you compile,
   link, or package your programs, and does not restrict your
   end users' ordinary use of the programs you give them.

7. You may not use the names, logos or trademarks of the
   Licensor (including Habarisoft) or its suppliers to market
   your programs, except to state that your program was
   written using the Framework.

The Framework, including its source code and all other
files, remains the Licensor's exclusive property. Regardless
of any modifications that you make, you may not distribute
any files of the Framework (particularly its source code and
other non-executable files), except as compiled into your own
programs.


BUSINESS CUSTOMERS ONLY
This commercial license is offered exclusively to businesses
(entrepreneurs within the meaning of section 14 of the German
Civil Code, BGB), including freelancers acting in their
professional capacity. It is not offered to consumers.


WARRANTY
The complete source code of the Framework is publicly
available, and you are able to evaluate it under the AGPL
before purchasing this license. The Framework is therefore
provided in its current state ("as is"). The Licensor gives
no guarantee (Garantie) and does not warrant that the
Framework is free of defects, will run without interruption,
or is suitable for a particular purpose.

To the extent that statutory warranty claims for defects
nevertheless exist, the limitation period is twelve (12)
months from the start of the subscription period in which
the affected version was obtained. This does not apply to
defects that the Licensor has fraudulently concealed.


LIABILITY
1. The Licensor is liable without limitation for damage
   caused intentionally or by gross negligence, for injury to
   life, body or health, for defects that the Licensor has
   fraudulently concealed, and under the German Product
   Liability Act (Produkthaftungsgesetz).

2. For slight negligence, the Licensor is liable only for
   breach of an essential contractual obligation, that is, an
   obligation whose fulfilment makes proper performance of the
   agreement possible in the first place and on which you may
   regularly rely. In that case liability is limited to the
   damage that was foreseeable and typical for this kind of
   agreement at the time it was concluded, and in any event to
   the license fees you paid in the twelve (12) months before
   the event giving rise to the claim.

3. Otherwise, the Licensor's liability is excluded.

4. You are responsible for backing up your data regularly and
   in a manner appropriate to its importance. Liability for
   loss of data is limited to the cost of restoring it from
   such backups.

5. These limitations also apply in favor of the Licensor's
   employees, representatives and agents.


GOVERNING LAW AND JURISDICTION
This license is governed by the laws of the Federal Republic
of Germany, excluding the United Nations Convention on
Contracts for the International Sale of Goods (CISG). If you
are a merchant (Kaufmann), a legal entity under public law or
a special fund under public law, the exclusive place of
jurisdiction for all disputes arising from this license is the
Licensor's place of business.


SEVERABILITY
If any provision of this license is or becomes invalid, the
validity of the remaining provisions is not affected.
